1. Agreement and Parties

    (a) These Terms and Conditions (the “Terms”) are a legal agreement between you (“the customer”) and Oday Shop Tanzania, registered in Tanzania with offices located at Ilala, Dodoma Street, Dar es Salaam, Tanzania.

    (b) “We”, “us”, and “Oday Shop Tanzania” refer to the applicable Oday Shop Tanzania contracting party.

      2. Use of Services

      (a) The Terms govern your use of the Oday Shop Tanzania Services (as defined below).

      (b) By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by these Terms.

      (c) These Terms apply to all users of the site, including without limitation users who are browsers, suppliers, customers, and/or contributors of content.

      3. Governing Law and Jurisdiction

      (a) The Terms shall be governed by and interpreted in accordance with the laws of the United Republic of Tanzania applicable therein, without regard to principles of conflicts of laws.

      (b) The parties irrevocably and unconditionally submit to the exclusive jurisdiction of the courts of Tanzania with respect to any dispute or claim arising out of or in connection with the Terms.

      4. Language and Interpretation

      (a) The Terms may be available in languages other than English.

      (b) To the extent of any inconsistencies or conflicts between these English Terms and Terms available in another language, the most current English version of the Terms will prevail.

      5. Severability

      (a) If any provision, or portion of the provision, in these Terms is, for any reason, held to be invalid, illegal, or unenforceable in any respect, then such invalidity, illegality, or unenforceability will not affect any other provision (or the unaffected portion of the provision) of the Terms.

      (b) The Terms will be construed as if such invalid, illegal, or unenforceable provision, or portion of the provision, had never been contained within the Terms.

      6. Acceptance of Terms

      (a) Please read these Terms of Service carefully before accessing or using our website/App.

      (b) By accessing or using any part of the site, you agree to be bound by these Terms of Service.

      (c) If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services. (d) If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service.

      (a) By agreeing to these Terms of Service, you represent that you are at least the age of 18, or that you are the age of 18 and over and you have given us your consent to allow any of your minor dependents to use this site.

      (b) Some of our products from the hardware category and service are not warranted.

      (c) These restrictions may include orders placed by or under the same customer, the same payment method, and/or orders that use the same delivery address.

      (d) In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the phone number or email provided at the time the order was made.

      (e) We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers, or distributors.

      (f) You agree to provide current, complete, and accurate personal and purchase information for all purchases made at our store.

      15. Shipping Policy

      (a) We pride ourselves on delivering quality, not just quality building materials but also quality service to each and every one of our customers.

      (b) When you decide to buy from us, we make a commitment to you to deliver quality at every moment.

      (c) Once you are our customer, you are part of the Oday Shop Tanzania family, and just like family, we like to care for our customers.

      (d) Orders typically take 3 hours or 2-3 business days to process.

      (e) Shipping within Dar es Salaam is within 3 working hours, and outside Dar es Salaam (within Tanzania) takes 2-3 business days.

      (f) Oday Shop Tanzania ships your products once payment has been received through our designated payment accounts.

      (g) Products will be shipped with all relevant documents, including a delivery note and an Electronic Fiscal Device (EFD) receipt.

      16. Payment Options

      (a) We accept manual payment, cash, and cheque.

      (b) All payments should be made to the CRDB account of Oday Shop Tanzania.

      (c) Cash payments can be made directly to customers who visit our office or to their representatives.

      (d) Secure payment links provided by Oday Shop Tanzania are also accepted.

      17. Currency for Payment

      (a) All payments for goods and services must be made in Tanzanian shillings.

      18. Secure Ordering

      (a) To protect your personal information, we take reasonable precautions and follow industry best practices to ensure it is not inappropriately lost, misused, accessed, disclosed, or destroyed.

      (b) We prioritize your security when ordering through various channels like WhatsApp, Call, SMS, Forms, and Email.

      (c) Here’s how we ensure secure ordering:

      (2) End-to-End Encryption: We use WhatsApp’s end-to-end encryption to protect your messages.

      (3) Secure Payment Links: Receive secure payment links that direct you to a trusted payment gateway.

      18(b). Call

      (1) Customer Verification: We use a verification process to confirm your identity.

      (2) Secure Handling of Information: We never ask for sensitive information like credit card numbers over the phone.

      (3) Encrypted Systems: Your data is stored in encrypted systems.

      18(c). SMS

      (1) Short Codes: We use dedicated short codes for sending and receiving order information.

      (2) Encrypted Messaging Services: Our SMS services offer encryption for added security.

      (3) Payment via Secure Links: We provide payment options via secure links instead of collecting sensitive information through SMS.

      18(d). Forms

      20. Your Order Cancellation Rights

      (a) You are entitled to cancel your order within 12 hours without giving any reason for doing so.

      (b) In order to exercise your right of cancellation, you must inform us of your decision by cancelling your order on the website or by using our email address: info@odayshoptanzania.com

      (c) We cannot cancel your order if it has already been shipped.

      21. Warranties

      (a) This sale is subject to such warranties as may be implied by the law relating to the nature of the products.

      (b) The exercise of the manufacturer’s warranties (if any) shall be as stipulated in the executed product warranty documents.
